ACCEPTABLE USE POLICY A.U.P - TERMS OF SERVICE T.O.S.
StreamingPulse is a provider of Internet related services such as Audio Video media streaming, dedicated and reseller servers,
This Agreement sets out the terms which have been agreed between Streaming Pulse and the Client for the provision of such Streaming services and shall be supplemented from time to time by Schedules setting out specific details of such services requested by the Client.
This Agreement shall come into effect upon the date of this Agreement and, subject to the provisions of this Agreement shall continue in force for an initial term of 1 month from the date the Services are available to the Client and indefinitely after that until terminated by either party giving not less than 30 days prior written notice to expire on or after the expiry date of the initial term.
1) Fees And Costs
All payment is in U.S.D. currency. All pricing is guaranteed for the term of payment. StreamingPulse reserves the right to change prices at any time, unless other terms have been agreed upon.
2) Billing Payment Policies
We accept payment made by PayPal's, Visa,Master Card, Moneybookers, Google Checkout,Wire transfers.
The price and all other amounts due under the Schedule shall be paid by the Client by the due date as specified in StreamingPulse invoice.
StreamingPulse reserves the right to suspend the Services in case of late payment. Any exercise by StreamingPulse of its right to suspend the Services in the case of late payment shall be without prejudice to any other of its rights under this agreement.
Notwithstanding suspension of the Services by StreamingPulse the Client shall continue to pay the price for the Services in accordance with the terms of this Agreement until this Agreement is terminated in accordance with the terms of this Agreement. StreamingPulse understands and will exercise its statutory right to interest and debt recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998 if not paid according to agreed terms.
3) Suspension
a.If an account is in arrears for over 7 days, the account will be suspended.
b.If an account is in arrears for over 30 days, the account will be closed and all files deleted from the server.
StreamingPulse reserves the right to send overdue accounts to a debt collection agency. All charges involved in the collection of overdue accounts will be payable by the Client.
4) Refund Policy
Once streaming service has been set up, payment will not be refunded for any reason.

5) Cancellation
This Agreement shall come into effect upon the date of this Agreement and, subject to the provisions of this Agreement shall continue in force for an initial term of 1 month from the date the Services are available to the Client and indefinitely after that until terminated by either party giving not less than 30 days prior written notice to expire on or after the expiry date of the initial term.
6) Content
Client agrees to take sole responsibility for all content, including audio streaming, web pages, and any other service that is utilized.
StreamingPulse is not liable for any action taken against a client as a result of their stream content or web content.
7) Licenses
Client is solely responsible for any applicable license fees for their location.
StreamingPulse does not award free licensing to clients, such as ASCAP, BMI, SESAC, RIAA, SIAE, GEMA or CARP.
8) Spam
Client will not use our resources to transmit bulk or spam e-mail. This is defined as mail sent to a large group of recipients who did not expressly request to be sent the e-mail.
9) Responsibility
StreamingPulse will not be held responsible for any loss of business, property, data, or any other misfortune caused by the use of the provider's service. StreamingPulse will make every effort to provide an uninterrupted Internet connection; however, we cannot warrant that the connection will be error free or uninterrupted. We are committed to perform full monthly day's and weekly incremental back-ups; however,
StreamingPulse will not be held responsible for any indirect, incidental or consequential damages incurred with lost data that may result. StreamingPulse is hereby waived of any legal obligation appertaining to the use of our service.

11) Revisions to this TOS
We reserve the right to revise, amend, or modify this AUP, our TOS (Terms of Service) and our other policies and agreements at any time and in any manner.
Notice of any revision, amendment, or modification will be posted in accordance with our TOS (Terms of Service).
